Move Over Dick

Never mind that we’ve had common law in this country since Richard II’s time. A form of law that is the “law between men”. A sensible, pragmatic, and importantly, a system of law that is based upon the principles of liberty – that is, everything is permitted unless specifically prohibited – no, apparently we need the EU for the rule of law.

The EU is an entity of laws and, as famously noted by the European court of justice, it is “a community based on the rule of law”. The sensibility or desirability of EU rule-making can be debated, but what is undeniable is the positive impact the union has on the consolidation of law-based approaches both in its members and the wider world.

Bullshit. EU nations, such as France, is based upon Napoleonic law – everything is banned unless specifically allowed. The very opposite of common law. It is highly illiberal and we should resist it with every fibre of our being. Already we have acquiesced too much. The idea that, somehow we would become lawless upon Brexit is to ignore nearly a thousand years of civilisation and an evolving legal system that is not the joke we see across the Channel. Fuck ’em.

I mean, seriously, the Meredith Kercher fiasco in Italy is an example of what we are supposed to be aiming for? Really? Our system of law may be far from perfect, but it is a beacon of civilisation compared to what our continental cousins have to endure.

So, more scaremongering nonsense from the remaindeers.

This reminds me of the only really concrete argument that I’ve heard amongst my Left leaning, pro-EU friends – that if we left the EU the eeeeeevil Tories and eeeeeeeevil multi-national corporations would immediately start abusing the workforce because it is only EU legislation which is preventing them from making people work 168 hour weeks for pennies an hour or that provides sick pay, paid holidays, maternity pay and so forth. Because destroying the morale of the workforce and abusing them is the best way to make a profit, apparently. I’m pretty undecided about the vote, but it’s this kind of ‘we’re all going to devolve into savages!’ nonsense which almost makes me want to vote leave simply out of spite…

    • Yes, several of which were coming in before we joined the then EEC. For example, Paid holiday in the UK dates back to 1871, for bank holidays and paid leave to 1938. However did we manage it without being told by Brussels?

  2. Agreed with the comments re Common Law and the comments regarding the rights enjoyed by the UK citizen. What the scare mongers fail to take into account the first people to enjoy rights like these in a developed country was the UK. If we leave the UK besides some early stock market turmoil very little will actually change.

    • On the surface “very little will actually change”, but in reality it will be an enormous change. Either, we will stop fighting our corner and give in to the EU dictatorship (remember you cannot remove them) or we will have chosen to “Man Up” and seek our own destiny in our own way. I sincerely hope to God its the latter.

  3. There seems to be a bizarre notion that if we hadn’t joined the EU we would still be in the same the legal situation as of 1973.
    Somehow societal developments which have been reflected in the laws of every single liberal Western democracy would have mysteriously passed us by.
    And Little Jimmy Osmond would still be top of the charts apparently.
