An Englishman’s Home…

..is his castle. A good outcome here and the two thugs got precisely what they served.

A farmer who used a forklift tractor to move a car parked on his land was today cleared of dangerous driving after telling the jury, ‘An Englishman’s home is his castle and my castle starts at that front gate’.

Fourth-generation hill farmer Robert Hooper, 57, insisted he had a lawful right to defend his property, with his barrister arguing on the basis of a 400-year-old precedent set by the legendary jurist Sir Edward Coke.

In a ruling known as Semayne’s case, Sir Edward established the Common Law principle that everyone has the right to defend their home, and – while issuing his ruling – uttered the famous phrase.

Jurors today found themselves with the task of deciding whether the same principle applied to what happened one day in August last year.

It would appear that in a rare show of common sense and decency, they did. Well done. The video is a delight to watch.

  1. Yes, was good to see at the time, and doubly so now that he can get on with his life.

    If he’d been allowed to get on with his life in the first place, wouldn’t have happened. I did read that the reason for the parking was a double puncture. I can’t say I’ve looked at the video with that in mind, but I imagine we’ve all driven a car with a flat (or two) a few yards to safer and more convenient positions without issue.

    Entirely possible that the flats were as a result of the (snigger) intervention.

    • I’ve ridden bikes with flats to get to a safe place. That was never an excuse. If you look where they were, they were well onto his land and blocking the entrance.

  2. Yeah I thought it was weak from having watched the video some time ago, couldn’t be bothered again. It was a typically wide farm gate entrance from memory, plenty of room to park the car somewhere out of the way.
